Karamanian, Dean of the College of Law at Hamad Bin Khalifa University (HBKU) explores environmental protection and investor-state arbitrations .
"The past decade has witnessed a major uptick in corporate codes and policies that reflect commitments of corporations to various levels of environmental protection, including the occasional acknowledgement of the Paris Agreement, as well as adherence to human rights standards and principles. What does this development mean for investor-state arbitration when the investor’s own words may be aligned with the very state action that forms the basis of the investor’s arbitration claim? In this session, I explore the contours of the issue as I encourage states, investors, and arbitral tribunals to take corporate codes seriously. "
