The rights of persons with disabilities in Kenya

During Day 8 of the 87th Ordinary Session of the African Commission on Human and Peoples’ Rights (ACHPR), Commissioner Hon. Marie Louise Abomo raised critical questions concerning the rights of persons with disabilities in Kenya, emphasizing inclusion, accessibility, participation, and equal access to justice. The intervention welcomed recent legal developments, including Kenya’s 2025 law on persons with disabilities and mental health reforms, while calling for concrete implementation measures to ensure that persons with disabilities can fully exercise their rights on an equal basis with others. Key issues highlighted included: • Inclusive and equitable access to services and opportunities; • Access to justice for women with disabilities facing gender-based violence; • Non-discriminatory access to reproductive healthcare; • The elimination of stigmatizing and discriminatory terminology in legislation; • Accessibility in transport, accommodation, and public services; • Affordability of assistive devices and disability-related services; • Participation of persons with disabilities in policymaking processes; • Protection of persons with albinism; • The transition from charity-based approaches toward a human rights-based model of disability inclusion. The discussions reaffirmed that disability rights are human rights and that States must adopt inclusive, rights-based, and participatory frameworks grounded in dignity, equality, and non-discrimination. #DisabilityRights #ACHPR #Accessibility #HumanRights #Inclusion #AccessToJustice #CRPD #GenderJustice #MentalHealth #RuleOfLaw
