Compensation in the International Law Commission

This event convened a panel discussion on the topic of “Compensation for the Damage Caused by Internationally Wrongful Acts,” following the 2025 decision of the International Law Commission (ILC) to include this subject in its programme of work and to appoint Professor Martins Paparinskis as Special Rapporteur. The discussion explored the conceptual foundations and practical challenges the ILC is likely to face in the codification and progressive development of international law in this area. Topics included the scope and forms of compensation, evidentiary and causation issues, valuation methodologies, the relationship between compensation and other forms of reparation, and the broader systemic implications for States and international dispute settlement. The panel was chaired by Professor Martins Paparinskis (University College London; Member of the International Law Commission), who introduced the ILC’s new topic and reflected on his mandate as Special Rapporteur.
